The California Supreme Court just released its long-awaited decision on CBIA’s challenge to the City of San Jose inclusionary housing ordinance. A big win for the City. Hinting at the outcome, the opinion begins with language from the Health and Safety Code citing to the serious housing shortage in California. The court concludes the inclusionary requirements are not an impermissible exaction on housing developers.
